Abstract:Based on the analysis of the governance track of sand and stone pilfering in P county,this paper discusses the practice path of legalization of rural governance.This paper argues that the predicament of the legalization of rural governance is mainly reflected in how to deal with the residual of the law.The legalization of rural governance is not only the result of the transformation of rural governance mechanism,but also the result of grass-roots legal practice.This process includes three steps:to clean up the remaining affairs of the law in rural governance practice and transform the chronic diseases of governance into legal facts; to redeploy the rural governance and introduce the law enforcement to the rural governance practice,thus making the practice legally-based; to integrate the concept of bureaucratic legal system into the rural governance practice and clarify the authority of legal decisions through the establishment of an open and transparent performance appraisal system.In this way,the law-based governance is the inevitable requirement in rural governance practice,other than the passive result of “sending the law to the countryside” on part of the country and the the natural product of the modern judicial concept.
