    关于征地拆迁,法律关系主体是作为征地拆迁方的国家和作为被征地拆迁方的土地相关权利人,二者之间是行政法律关系。实地调研发现,当前征地拆迁中常涉及三类主体:农户、开发商和政府,由于开发商介入征地,征地拆迁中的补偿标准逐渐由政府规定标准转变为农户与开发商的协商标准。通过对开发商介入的征地拆迁模式的发生机制和实践后果展开分析,发现该模式训练了农民的谈判能力,被征地拆迁的农民正在成为土地增值收益的分享者,而调整措施的缺失将会导致这部分群体转化为土地食利者阶层。

    Abstract:

    In land acquisition and demolition, the legal relationship is between the state and the right subjects, which is administrative legal. Field research found that the current land acquisition and demolition often involves three types of subjects: farmers, developers and the government. Because the developers are involved in land acquisition and demolition, compensation standards of land acquisition gradually transformed from standard developed by the government to standard formed through consultation between farmers and developers. The study shows that negotiating ability of farmers is trained in the current interest game mode, and the landless farmers are becoming the sharer of value increment income of land. Lack of adjustment measures will lead the group into land rentier class.
