    摘要:

    工商业资本下乡是一个不可阻挡的趋势,且“工商业资本大量进入农业是‘双刃剑’”,社会各界反响强烈。目前只有政策上作了较为原则的规定,政策缺乏刚性和强制效力。必须依靠法律手段,运用强有力的法律武器和通过健全的农地租赁法律制度来全面调整和规范,才能使工商企业租赁与使用农户“家庭承包地”真正实现有法可依、有法能依、违法必究。在较为全面系统分析现行政策和相关法律内容、出租之法律规范梳理和运行机理、存在的法律问题等基础上,提出了从界定各类涉农主体资格、明确准入门槛条件、建立审核批准制度、完善“非粮化”与“非农化”的法律约束机制、健全租赁合同的解除机制、加强专项立法等6个方面来规范工商企业租赁与使用农户“家庭承包地”的法律对策建议。

    Abstract:

    It is an irresistible trend for industrial and commercial capital to flow to the countryside.Commercial capital into agriculture is a “double-edged sword”,which has made the community react strongly.At present the policy has only stipulated several principles,thus lacking rigidity and enforcement.We hold a strong belief that rental of commercial enterprises and usage of farmers’ “Family Contracted Land” should be adjusted and regulated through the sound land leasing legal system and the usage of strong legal weapons,and only in this way can we make the prospect of “there’re laws to abide by,there’re laws to comply with,law breakers must be dealt with” come true.This paper is based on the following points:analysis of the current policy and related comprehensive system,analysis and operation mechanism of legal norms of rental,the existing problems of law.Finally,six aspects of the legal countermeasures and suggestions have been put forward as follows to regulate the rental and usage of family contracted land on the part of the commercial enterprises:clearly define the qualifications of the agriculture-related entities and the conditions for the entry threshold,set up examination and approval system,improve the legal restraint mechanism of “Non-food” and “Non agriculture”,lift the mechanism of the leasing contract and reinforce special legislation.
